General Terms and Conditions (GTC)
1. Scope of Application
Altus Montres S.A. operates a watch brand and website under the name “Piccola & Jofrette” with the possibility to purchase watches. The following General Terms and Conditions (GTC) govern the contractual relationship between Altus Montres S.A. (hereinafter referred to as “we”) and customers (hereinafter referred to as “you”) who purchase goods and services via this webshop in the version valid at the time the contract is concluded.
2. Offer
The offers on our website are non-binding. They are only valid as long as a product is available. We reserve the right to adjust prices and product ranges. The products are described to the best of our knowledge and belief. Slight variations in size, color, structure, and workmanship are possible.
3. Order and Conclusion of Contract
With an e-mail order or, in the case of a telephone order, with the verbal transmission of the order data, you submit a legally binding offer to conclude a purchase contract and accept these GTC and the prices shown. You will receive a confirmation of receipt of your order from us. This confirmation does not constitute acceptance of the offer by us. The legally binding contract is only concluded when the order confirmation is sent by e-mail.
4. Prices
The prices are shown in Swiss francs (CHF) including shipping costs. The prices include 8,1% value added tax (VAT no. CHE-394.421.681). Swiss VAT is not charged on the product price for deliveries abroad. However, additional import costs (customs clearance, customs duties, local VAT, etc.) may be incurred. These shall be borne by the buyer.
5. Payment
Payment is only possible with the means of payment accepted on the website. At the moment these are:
- Prepayment by bank transfer within 5 working days (if no payment is made within 30 days of receipt of the order, the order will be canceled)
- Credit cards
6. Delivery and Delays
As a rule, we deliver worldwide, if delivery can be made by Swiss Post and its partners. The watch is usually dispatched within 5 working days of completion. You will be informed by e-mail about the time required to build the watch. General exceptions are indicated on the website.
The delivery will be sent by Swiss Post (priority, registered). The watch can also be collected by arrangement. The declaration of the value of the goods always corresponds to the invoice amount.
We are not liable for delays in delivery caused by manufacturers, producers, third parties or force majeure. In the event of delays in delivery of more than one month, you have the right to withdraw from the contract without prior warning.
If the delivery is not accepted or collected by you and returned to us, we will charge you for the entire transportation costs and any additional costs incurred.
7. shipping costs
The shipping costs (packaging and transportation) are:
- Shipping within Switzerland: free of charge
- Shipping outside Switzerland: free of charge
- Special shipping within Switzerland or abroad: charged at cost
8. Right of Return
You can return ordered goods to us within 14 working days from the date of dispatch at your own expense and risk. This does not apply to items that have already been used. The goods must be undamaged, complete and in their original packaging. The reason for the return must also be stated. If these criteria are met, you will be refunded the purchase price minus the shipping costs in accordance with section 7. If the return criteria are not met, we may refuse to accept the return.
All watches that have been personalized with your name are expressly excluded from this right of return. In this case, the return procedure must be defined in detail between the seller and the buyer.
9. Warranty
Please check the delivered goods immediately and report any defects to us by e-mail immediately, but no later than 5 days after receipt of the goods. The defective goods must be returned to us within 14 days of receipt. The shipping costs will be borne by us. Warranty claims expire for reports or returns received late.
New watches come with a 2-year guarantee. Details can be found in the “Warranty” section.
10. Final Provisions
The GTC and the contracts concluded on the basis of these GTC are subject to Swiss law to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Bern. We reserve the right to change the GTC at any time. The currently valid version will be published on our website and will apply from the time of publication.
In the event that individual provisions of these GTC should be wholly or partially invalid, this shall not affect the validity of the remaining provisions.
